1. Agreement to terms
By downloading, installing, or accessing an application developed or distributed by Nemitek, or using this website, you agree to these terms. If you do not agree, discontinue use of the applicable product or service. Separate terms or licenses supplied with a product also apply.
2. Software and licenses
Unless a separate product license provides otherwise, Nemitek grants you a personal, non-exclusive, non-transferable, revocable license to use its applications in accordance with these terms. Rights in Nemitek’s branding and original materials remain with their respective owners.
Some products or components are distributed under open-source licenses. Those licenses govern the relevant software and take precedence over any conflicting restriction in these terms. Nothing here limits rights granted to you by an applicable open-source license.
3. Acceptable use
You agree not to use our services to transmit abusive, unlawful, or infringing content; interfere with service infrastructure; launch denial-of-service attacks; or bypass access controls. Restrictions on decompiling or reverse-engineering proprietary software apply only to the extent permitted by applicable law and the product’s license.
4. Availability and limitation of liability
Products and services are provided on an “as is” and “as available” basis, without warranties of any kind to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Features and availability may change.
To the fullest extent permitted by law, Nemitek is not liable for indirect, incidental, special, or consequential damages arising from use of its software or services. Nothing in these terms excludes rights or liability that cannot lawfully be excluded.
Local product data may be affected by browser settings, device resets, or app removal. You are responsible for maintaining copies of any files or other data you wish to keep.
